Article 1. Preamble

These General Terms and Conditions of Sale (hereinafter the "GTC") are agreed between Grosfillex SAS (hereinafter "Grosfillex" or "the Seller") and any natural person of legal age wishing to make a purchase on the Website for personal use (hereinafter the Buyer). They aim to define the general and specific terms and conditions applicable to any purchase of goods by the Buyer on the Website (hereinafter the "Order"). They apply, without restriction or reservation, to all sales of products offered by Grosfillex on its Website.

Consequently, ordering a product offered for sale on the Grosfillex Website implies full and complete acceptance of these GTC and the "Personal Data and Cookies" policy, which the Buyer acknowledges having read prior to placing their Order.

Grosfillex reserves the right to modify these T&Cs at any time without notice. Therefore, the Buyer is invited to regularly consult Grosfillex's T&Cs. Nevertheless, the T&Cs applicable to the Order are those that have been accepted by the Buyer at the time of placing the Order.

These conditions apply exclusively to individuals who are not merchants.

The grosfillex.com online store is exclusively reserved for purchases by private individuals.

Article 2. Products

2.1. Product characteristics

The Buyer may review the essential characteristics of the products offered for sale by Grosfillex on the Website.

The products sold by Grosfillex are intended for non-professional customers, for their personal use. Grosfillex takes the utmost care in the visual representations of the products it displays on the Website.

However, due to computer processing of images and despite the care taken in creating these visual representations, the dimensions and/or colors and/or packaging of the products may be slightly different from reality.

These visual representations are for illustrative purposes only and in the event of any discrepancy between the image and the product description, the product description shall always prevail.

2.2. Product availability

Unless otherwise specified, the offers presented on the Website are valid as long as the products appear in the electronic catalog and while stocks last.

In any event, and in the event of total or partial unavailability of products after placing the Order, the Buyer will be informed by email as soon as possible of the unavailability of the product and the total or partial cancellation of their order. In this case, the Buyer will be refunded the price of the unavailable product as soon as possible and no later than 14 days from the date of their order.

2.3. Product compliance

The products sold on the Site comply with the regulations in force relating to the safety and health of persons, fair trading, and consumer protection at the time they are placed on the market.

Article 3. Rates

The prices of products sold on the website are indicated in euros and include all taxes. Prices are those in effect at the time the Buyer confirms the Order. They are valid in mainland France only.

Prices do not include shipping costs, which are charged in addition to the price of the products and indicated to the Buyer before the Order is placed. Any customs duties or local taxes are entirely the responsibility of the Buyer.

The selling prices of products may be modified by Grosfillex at any time. However, invoicing is carried out according to the prices in force at the time of confirmation of the Order by the Buyer, subject to the availability of the products ordered.

Article 4. Ordering

4.1. Conclusion of the contract

It is hereby reiterated that the products offered for sale on the Website are intended for private consumers for non-professional use. As such, Grosfillex reserves the right to refuse any Order whose volume, number of items, or amount does not correspond to the average usual use of a private individual and presents characteristics that would justify Grosfillex suspending the order pending receipt of supporting documentation guaranteeing that the products are indeed being purchased for the Buyer's personal needs.

To place an Order, the Buyer adds the desired products to "My Cart" by clicking on the button provided for this purpose, having first selected the quantity and/or color of the desired product.

The contents of the shopping cart can be accessed at any time by clicking on the "Shopping Cart" icon on each page of the Eboutique website. The Buyer may modify the quantities and delete products if necessary.

Once the products and quantities have been selected, the Buyer clicks on the "Place Order" button and provides the information relating to delivery, billing, and payment method. 

Before clicking on the "Pay Now" button, the Buyer has the opportunity to check the details of their Order and its total price (including delivery costs) and to return to the previous pages to correct any errors.

After verifying and confirming the Order, the Buyer chooses their payment method and confirms the order.

Confirmation of the Order implies full and complete acceptance of these Terms and Conditions and forms the contract.

An email acknowledging receipt of the Order and payment will be sent to the Buyer by Grosfillex as soon as possible.

Pursuant to Article L121-11 of the French Consumer Code, Grosfillex also reserves the right to refuse any Order in the event of a dispute concerning payment for a previous Order by the Buyer or in the event of refusal of payment authorization by banking institutions.

4.2. Order Modification

Once the order has been confirmed and payment accepted, it cannot be modified. Before confirming the order, the buyer must ensure that the items selected are correct, as well as the delivery and billing details.

4.3. Unavailability of ordered products

In the event of total or partial unavailability of products after placing the Order, the Buyer will be informed as soon as possible. With the exception of clearance items, the company may replace the product with a similar item.

4.4 Order Cancellation

Once the buyer has made payment, it is not possible to cancel the order.

Article 5. Payment 

The following payment methods are accepted:

5.1 Credit card

5.1.1 Cash payment 

The following credit cards are accepted on the Website: Carte Bleue, Visa, MasterCard. 

The credit card will be charged for the total amount of the Order no later than 7 days after the order has been confirmed. 

Online payments are secure thanks to the SECURE 3D security system implemented by Shopify (via the Payplug module).

In the event of a dispute or refusal of payment by officially accredited banking institutions, Grosfillex reserves the right to suspend or cancel the delivery of the Order, as well as to refuse or cancel any Order from a Buyer with whom there is an ongoing dispute relating to the payment or return of an Order.

5.1.2 Credit card, payment in 2, 3, or 4 installments with no fees 

Grosfillex.com offers the option of paying in two, three, or four installments at no extra cost by credit card. The first debit (deposit) is equal to the purchase amount divided by two, three, or four, depending on the option chosen. It is debited no later than five days after the date of the order. The monthly payments are then made by credit card in 1, 2, or 3 installments, on the 30th, 60th, and 90th day from the date of purchase. 

Information relating to orders paid for using the 2, 3, or 4 interest-free remote credit card payment solution is subject to automated data processing, for which FIA-NET S.A. is responsible. The purpose of this automated data processing is to determine the level of insurance for a transaction and to combat payment fraud, particularly credit card fraud.

FIA-NET S.A. and Grosfillex are the recipients of data relating to the order. Failure to transmit data relating to the order will prevent the transaction from being carried out and analyzed.

The occurrence of an unpaid debt due to fraudulent use of a credit card or other means of payment will result in the data relating to the order associated with the unpaid debt being recorded in a payment incident file maintained by FIA-NET S.A. An irregular declaration or anomaly may also be subject to specific processing.

In accordance with the French Data Protection Act of January 6, 1978, the Buyer has the right to access, rectify, and delete all of their personal data recorded by FIANET at any time by writing, by mail and providing proof of their identity, to FIA-NET – Data Protection Department – Processing Nos. 773061 and 1080905 – 3/5 Rue Saint Georges, 75009 PARIS.

In accordance with regulations governing financial services sold remotely, the Buyer has a fourteen-day withdrawal period for their credit agreement, subject to the conditions set out in Article 7. Exercising this right does not result in the termination of the sales agreement, unless the Buyer also withdraws from that agreement. 

As for the withdrawal from the sales contract, it results in the termination of the 2x, 3x, or 4x interest-free credit card contract. In this case, Grosfillex must refund the deposit to the Buyer within 14 days.

5.2 PayPal

The PayPal service allows the Buyer to complete their order by sending electronic money online to our Grosfillex PayPal account. 

To do so, the Buyer must open an account on the website www.paypal.com after accepting the website's terms and conditions in order to be able to pay for their purchases online.

The terms and conditions of use for PayPal via the grosfillex.com website are subject to the terms and conditions set out on the PayPal website www.paypal.com.

Article 6. Delivery 

6.1. General rules

When the Order is shipped, the Buyer will receive an email containing the package reference number, the address, and the delivery terms.

Deliveries are made only in mainland France, excluding Corsica and the islands.

6.2 Shipping costs

The buyer is required to contribute to delivery costs for all purchases made on the grosfillex.com website.

Shipping costs are calculated directly on the website and depend on the volume of the order and the department to which it is delivered.

The amount of the contribution to delivery costs is indicated at the time of ordering and is summarized before payment.

6.3 Unpacking instructions

Upon receipt of your order, we ask that you examine and open the packages in front of the carrier and carefully check that your goods are in good condition before signing the delivery note. 

It is important to check your products upon receipt of your delivery and to detail any reservations on the delivery note before signing. 

General reservations such as "subject to unpacking" have no legal value. It is therefore necessary to issue specific reservations, defining any missing or damaged items.

We also ask that you note all visible damage to the package on the delivery slip, specifying "Damage to original packaging" (EO = emballage d'origine) and describing the type of damage.

If you have any reservations, be as specific as possible (breakage, defect, scratch, condition of the packaging) and feel free to take photos of the packaging or your products.

The delivery note legally certifies your agreement with the condition of your goods and your acceptance of them in that condition.

6.4. Delivery terms

The Buyer may choose to have their order delivered:

  • At home

Our delivery times are calculated from the moment the order is finalized and ready to leave our warehouse.

If our delivery time exceeds 30 working days, the Buyer shall be entitled to terminate the contract under the conditions set out in Article L 216-2 of the French Consumer Code. In this case, Grosfillex shall reimburse the Buyer for all sums paid within 14 days of the date of termination of the contract.

The Buyer can track the delivery of their package:

  • Either on our website under the "My Account" tab, by selecting "My Orders" and then clicking on the relevant order ("reference" link).
  • Either via the URL provided in the carrier's email informing them of the shipment of their package, 
  • Either by phone call from the carrier (text message or call).

Any Order not received at the address specified by the Buyer thirty days after shipment shall be considered lost. In this case, Grosfillex undertakes to refund the buyer the total amount of the order within 14 days.

Any complaint regarding a delivery error must be made by the consumer to Grosfillex on the day of delivery, or at the latest on the first working day following delivery.

6.4.1. Home delivery

Home delivery is carried out by a carrier selected by us. 

In this case, the delivery time is 8 business days for orders including a shelter and 2 to 6 business days for other orders, starting from the date of Grosfillex's order confirmation. 

Home delivery is made to your doorstep or the foot of your building, excluding upper floors and basements. The delivery driver is not authorized to enter your property.

In the event of a delay in delivery by postal parcel, customers are advised to check with their post office to see if the parcel is on hold, and then report the incident to customer service if necessary.

For garden sheds, delivery is understood to be in front of the house (property) or at the foot of the building (roadside or sidewalk). The delivery date announced at the time of ordering is indicative and will be confirmed by the carrier by telephone, at least one week prior to the week of delivery. The appointment is agreed for a half-day, if possible within a 2-hour window, which will be confirmed by the carrier a few hours before delivery. The delivery location must comply with the instructions provided to the carrier and must allow a heavy goods vehicle (L:18m, W:3m, h:4m15) to access it from a sufficiently close distance (300 meters in large urban areas, 1 km in rural areas) and to park without obstructing the flow of other vehicles. The designated parking area must allow a handling machine to unload the truck from the side.

ARTICLE 7. LEGAL RIGHT OF WITHDRAWAL

7.1. Legal right and period of withdrawal

In accordance with Article L. 221-18 of the French Consumer Code, the Buyer has a period of fourteen (14) days from the date of receipt of the last product ordered to exercise their legal right of withdrawal without having to justify their decision or pay any penalties.

However, in accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised in relation to:

  • Products that have been damaged due to handling that was not necessary for the purpose of establishing their nature, characteristics, and proper functioning 
  • Products that cannot be returned for reasons of hygiene or health protection

In the event of a discrepancy between the returned items and the accompanying invoice, Grosfillex will not issue a refund. 

7.2. Terms and conditions for exercising the right of withdrawal

Buyers who wish to exercise their right of withdrawal must inform Grosfillex Customer Service within fourteen (14) days of delivery of the Order. 

To do so, the Buyer must complete the online form on our website under the "Contact Us"tab, selecting "e-shop question" in the subject line of the request.

The cost of returning the products will be borne by Grosfillex, however the refund for the order will exclude delivery costs. The products will be collected by a carrier chosen by Grosfillex. The collection location (either at home, at a pick-up point, or at a post office) will be chosen by Grosfillex depending on the size of the product(s) concerned. Grosfillex Customer Service will inform the Buyer of the procedure to follow. In the event of home collection, the carrier will make an appointment with the Buyer by telephone. 

Buyers who wish to exercise their right of withdrawal must keep the products in their original packaging for fourteen (14) days after sending the withdrawal form to the following address:

Upon receipt of the withdrawal form, a return slip will be sent to the Buyer by email:

  • Either through Grosfillex Customer Service in the case of collection from a pick-up point or post office, 
  • Either by the carrier in the case of home collection.

Grosfillex will refund the full amount of your order EXCLUDING DELIVERY COSTS within 14 days of being notified of your decision to cancel. However, this refund may be deferred until the products are actually returned or until Grosfillex receives proof that the products have been returned. Grosfillex will only accept products that are returned in their entirety, with all items intact, unused, and in good condition in order to qualify for a refund.

 

ARTICLE 8. PROVISION OF SPARE PARTS

We will keep the spare parts necessary for the product to function available to buyers for a period of 6 months from the date of purchase.

ARTICLE 9. LEGAL WARRANTY

9.1. Legal warranty against hidden defects

The products sold on the Website are covered by the legal warranty against hidden defects provided for in Articles 1641 to 1649 of the Civil Code. 

Article 1641: "The seller is bound to a warranty on account of hidden defects in the item sold that render it unfit for the use for which it is intended, or that so impair that use that the buyer would not have acquired it, or would only have paid a lower price for it, had he known of them."

Article 1648: "Action resulting from latent defects must be brought by the purchaser within two years of discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, on pain of foreclosure, within one year of the date on which the seller can be relieved of apparent defects or non-conformities."

9.2 Legal warranty of conformity

The products sold on the Website are covered by the legal warranty against hidden defects provided for in Articles 1641 to 1649 of the Civil Code. 

Article 1641: "The seller is bound to a warranty on account of hidden defects in the item sold that render it unfit for the use for which it is intended, or that so impair that use that the buyer would not have acquired it, or would only have paid a lower price for it, had he known of them."

Article 1648: "Action resulting from latent defects must be brought by the purchaser within two years of discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, on pain of foreclosure, within one year of the date on which the seller can be relieved of apparent defects or non-conformities."

9.2 Legal warranty of conformity

The products sold on the website also benefit from the legal guarantee of conformity provided for in Articles L 217-4 et seq. of the Consumer Code.

The product complies with:

If it is fit for the purpose usually expected of a similar product.

If it corresponds to the description given by the seller and possesses the qualities that the seller presented to the Buyer in the form of a sample or model.

If it has the qualities that a buyer can legitimately expect given the public statements made by the seller, particularly in advertising or labeling.

If it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the Buyer, brought to the attention of the Seller and accepted by the latter.

The Buyer may bring an action for compliance within a period of two years following the actual date of delivery of the product.

9.3. Terms and conditions for implementing legal guarantees

Under the legal guarantee of conformity, Grosfillex undertakes, at the Buyer's discretion, to refund or exchange any products that are defective or do not correspond to the Order.

Under the legal warranty against hidden defects, the Buyer may choose between cancellation of the sale or a reduction in the sale price, in accordance with Article 1644 of the Civil Code.

For any questions regarding the implementation of the legal warranty, the Buyer may contact Customer Service.

ARTICLE 10. COMMERCIAL WARRANTY

Any warranties attached to items sold on the Website, as well as the terms and conditions governing the implementation of these warranties, are presented in the description sheets under technical specifications.

They only cover manufacturing defects and not problems related to impact or misuse of the product by the Buyer. 

ARTICLE 11. AFTER-SALES SERVICE

Claims made under the warranties must be addressed to Grosfillex Customer Service. To do so, the Buyer must complete the online form on our website under the "Needhelp" tab, selecting "e-shop question" in the subject line of the request.

Products covered by warranties must be returned new, complete, and in their original condition and packaging after receipt and confirmation of the claim by the after-sales service.

Upon receipt of the product(s), in the event of any inconsistency between the problem identified by Grosfillex technicians and the Buyer's claims, Grosfillex reserves the right not to send the item for repair or exchange.

If the Buyer wishes to recover their damaged or defective item, they can submit a request to Grosfillex Customer Service. To do so, the Buyer must complete the online form on our website under the " Need help " tab on our website, selecting "e-shop question" in the subject line of the request. In this case, the Buyer is responsible for the return shipping costs.

If the warranty period has expired or if the item is not covered by a warranty, Grosfillex may, depending on the item, offer to provide a quote at the Buyer's expense. In this case, the return and repair costs shall be borne by the Buyer.

ARTICLE 12. LIABILITY

Grosfillex shall in no event be held liable for any damage of any kind resulting from misuse of the products by the Buyer.

Similarly, Grosfillex cannot be held liable in the event of non-performance or poor performance of the contract due to the actions of a third party or to a case of force majeure.

ARTICLE 13. COMMENTS AND CRITICISMS

Buyers may post comments on the website and products via the "Verified Reviews" questionnaire sent to them by email after purchasing products on our website. These comments are verified and then edited on the condition that their content is not illegal, obscene, abusive, threatening, defamatory, slanderous, infringing on intellectual property rights, or prejudicial to third parties or reprehensible, and does not consist of or contain computer viruses, political activism, commercial solicitations, chain emails, mass mailings, or any other form of "spam." If the Buyer believes that their intellectual property rights have been infringed by an item or information published on the website, they may notify Grosfillex Customer Service via the "Contact Us"page on the website. 

ARTICLE 14. PERSONAL DATA – COOKIES

Grosfillex collects the Buyer's personal data. The purposes, recipients, and conditions under which Grosfillex collects and processes the Buyer's personal data, as well as the Buyer's rights with regard to this processing of personal data, are described in the "Personal Data and Cookies" policy available on the Website. 

ARTICLE 15. COMPLAINTS

For any complaints, the Buyer may contact Grosfillex Customer Service. To do so, the Buyer must complete the online form on our website under the "ContactUs"tab.

ARTICLE 16. DISPUTES – APPLICABLE LAW

These GTC and, more generally, the contractual relationship between Grosfillex and the Buyer are subject to French law.

In the event of a dispute relating to these GTC and/or the existence, interpretation, performance, or breach of the contract between Grosfillex and the Buyer, an amicable solution will be sought before any legal action is taken.

It is specified that the prior attempt to reach an amicable solution does not in any way interrupt the legal warranty period.

In accordance with Article L. 612-1 of the Consumer Code, within one year of their written complaint, consumers, subject to Article L.152-2 of the Consumer Code, have the right to submit a request for amicable resolution through mediation to:

The use of this mediation mechanism is free of charge for consumers and does not deprive them of the possibility of subsequently bringing their complaint before the competent courts.

Any dispute relating to these GTC and/or the existence, interpretation, performance, or breach of the contract between Grosfillex and the Buyer shall, in the absence of an amicable agreement, fall within the exclusive jurisdiction of the French courts.

ARTICLE 17. WITHDRAWAL FORM 

Please complete and return this form only if you wish to withdraw from the contract.
